These Terms of Service ("Terms") govern your use of practiceproof.com (the "Site") and your engagement of services from Practice Proof ("Practice Proof", "we", "us", "our"). By using the Site, or engaging Practice Proof for services, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Who we are
Practice Proof is a marketing, technology and AI agency that works exclusively with law firms, operating from Brisbane and Sydney, Australia, and serving clients across Australia, the United States, the United Kingdom, Canada and New Zealand.
2. Use of the Site
The Site and its content (including text, graphics, tools such as the free growth audit, and Practice Proof AI) are provided for general information about our services. You may not: copy, reproduce or republish content from the Site without our permission; use the Site to transmit unlawful, harmful or infringing material; attempt to gain unauthorised access to the Site or its underlying systems; or use automated tools to scrape or extract content at scale.
Content on the Site, including our published blog articles and the free growth audit methodology, is general commentary and does not constitute legal, financial or professional advice for your firm's specific circumstances.
3. Enquiries, forms and the free growth audit
Submitting a contact form, booking a consultation, or completing the free growth audit does not create a client relationship or any obligation on either party. A client relationship begins only once we've agreed on scope and terms directly with your firm, typically through a separate written engagement.
4. Client engagements
Where Practice Proof provides paid services to a law firm, those services are governed by the specific proposal, statement of work, or engagement agreement signed by both parties. Where these Terms and a signed engagement agreement conflict on a matter, the signed engagement agreement takes precedence.
Practice Proof generally operates on flat-fee pricing rather than hourly billing, as set out in the relevant engagement agreement.
5. Intellectual property
All content on the Site, our brand, logos, and the Practice Proof name are the property of Practice Proof and may not be used without our written permission. Deliverables produced for a client under a signed engagement are governed by the intellectual property terms of that engagement, not by this general policy.
6. Third-party services
The Site uses third-party services, including Formspree (form processing), Google Analytics (site analytics), and Vercel (hosting). Your use of these integrated services is also subject to those providers' own terms and privacy policies.
7. No warranty
The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any results (including from the free growth audit) reflect a guarantee of future marketing performance for your firm.
8. Limitation of liability
To the maximum extent permitted by law, Practice Proof will not be liable for any indirect, incidental, special or consequential loss arising from your use of the Site. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded, including under the Australian Consumer Law.
9. Links to other sites
The Site may link to third-party websites, including client and case study references. We are not responsible for the content or practices of any linked site.
10. Governing law
These Terms are governed by the laws of Queensland, Australia, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of Queensland, Australia, except where a client's signed engagement agreement specifies a different governing law.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after an update constitutes acceptance of the revised Terms.
